Interpretation
Words with an initial capital letter have meanings defined below. These definitions apply whether the terms appear in singular or plural form.
Definitions
For the purposes of these Terms and Conditions:
- Company, We, Us, or Our refers to Sawyer Fine Art LLC.
- Device means any device capable of accessing the Service, including a computer, mobile phone, or tablet.
- Feedback means any feedback, ideas, suggestions, or recommendations provided by You regarding the Service or Goods.
- Goods refer to original artworks, fine art prints, and any related items offered for sale through the Service.
- Orders mean a request made by You to purchase Goods from Us.
- Service refers to the Company website hosted via Shopify.
- Shopify refers to Shopify Inc. and its affiliates, the e-commerce platform provider hosting the Service.
- Third-Party Social Media Service means any services or content provided by a third party that may be displayed or made available through the Service.
- You means the individual or legal entity accessing or using the Service.
Acknowledgment
These Terms and Conditions govern Your access to and use of the Service and constitute a binding agreement between You and the Company. By accessing or using the Service, You acknowledge that You have read, understood, and agree to be bound by these Terms. If You do not agree with any portion of these Terms, You may not access or use the Service.
Your use of the Service is also subject to Our Privacy Policy, which outlines how personal information is collected, used, and protected. Please review the Privacy Policy carefully before using the Service.
You acknowledge that the Service is hosted on the Shopify e-commerce platform, and your interactions are subject to Shopify's technical ecosystem and underlying security policies.
Placing Orders for Goods
By placing an Order through the Service, You represent and warrant that You are legally capable of entering into a binding contract.
Your Information
When placing an Order, You may be required to provide certain information, including but not limited to Your name, email address, phone number, billing details, and shipping information.
You represent and warrant that:
- You have the legal right to use the payment method provided; and
- All information submitted is accurate, complete, and current.
By submitting payment information, You authorize Us to share necessary details with Shopify and secure third-party payment processors solely for the purpose of completing Your Order.
Orders, Returns, and Cancellations
All sales of original artwork are final. Prints and non-personalized Goods may only be considered for resolution in the event they arrive damaged or defective. Any such issue must be reported within 7 days of delivery. To initiate a claim, You must provide clear, well-lit photographs documenting the issue. Upon review, We will determine an appropriate resolution, which may include repair, replacement, or refund at Our sole discretion.
Personalized or custom pieces are not eligible for return, exchange, or cancellation. Order cancellations may be permitted only if production has not yet begun. Please note that production may commence shortly after an Order is placed.
Order Cancellation by the Company
We reserve the right to refuse or cancel any Order at any time for reasons including, but not limited to:
- Availability of Goods
- Errors in pricing or descriptions
- Errors related to Your Order
- Suspected fraud or unauthorized transactions
If an Order is canceled after payment has been processed, a refund will be issued using the original payment method through the platform's processing infrastructure.
Pricing and Payments Policy
All prices are subject to change prior to order acceptance. The Company reserves the right to adjust pricing, availability, or offerings at any time without prior notice. Shipping, handling, and tax parameters are calculated dynamically during checkout based on carrier rates and applicable rules. We may modify or discontinue the service, or any portion thereof, at any time. We shall not be liable for any modification, suspension, or discontinuation of the service.
All Goods require full payment at the time of purchase. Payments are processed securely as one-time transactions using integrated methods available at checkout. Payment authorization is subject to validation by your payment provider. Failure to receive authorization may result in delayed or canceled orders.
Intellectual Property
All artwork, images, designs, and creative content displayed on the service are the intellectual property of Pam A Sawyer, DC, and her children: Hunter Sawyer, Anastasia Sawyer, and Lila Sawyer and Sawyer Fine Art LLC. This intellectual property is protected under applicable copyright and intellectual property laws. Unauthorized reproduction, distribution, modification, or resale of any content without explicit written permission is strictly prohibited. The Company reserves the right to pursue legal action against any individual or entity that infringes upon these rights.
Severability and Waiver
Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be interpreted in a manner that best reflects its original intent, and the remaining provisions shall continue in full force and effect.
Waiver: Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision, nor shall any waiver of a breach constitute a waiver of any subsequent breach.
Changes to These Terms and Conditions
We reserve the right to modify or replace these Terms at Our sole discretion. Material changes will be communicated with reasonable notice when feasible. Continued use of the service following any changes constitutes acceptance of the revised Terms. It is Your responsibility to review these Terms periodically.
